NOTICE IS HEREBY GIVEN to the public and to all interested persons that under the legal authority and jurisdiction of Title 3, Oil and Gas, Subtitles A, B, and C of the Texas Natural Resources Code, Chapters 26, 27 and 29 of the Texas Water Code, and TEX. GOV’T CODE ANN. art. §§ 2001 et seq. (2009), the RAILROAD COMMISSION OF TEXAS will hold a hearing on March 10, 2009, at 9:00 a.m. at the William B. Travis State Office Building, 1701 N. Congress Avenue, Austin, Texas. This hearing will be conducted in conformity with the TEX. GOV’T CODE ANN. art. §§ 2001 et seq. (2009). For room assignment, on the date of the hearing please check the bulletin board in the 1st Floor lobby. The Commission will consider the application of Chesapeake Operating, Inc. for a spacing exception permit under the provisions of 16 Texas Administrative Code §3.37 (Railroad Commission Statewide Rule 37). Applicant seeks an exception to the lease line spacing requirement of the field rules for the Newark, East (Barnett Shale) Field, being 142 feet to the nearest lease line. The proposed well is nearer than allowed by the applicable spacing rules to unleased tracts interior to the pooled unit.
Applicant has made application to drill Well No. 2H, Novikoff Lease, Terrell, E S Survey, A-1527, Newark, East (Barnett Shale) Field, Tarrant County, being within the city of Fort Worth, Texas.
The location of this well is as follows:
Surface Location:
360 feet from the north line and 329 feet from the west line of lease.
363 feet from the north line and 1706 feet from the west line of survey.
Penetration Point Location:
330 feet from the west line and 848 feet from the north line of lease.
Terminus Location:
1359 feet from the southwest line and 463 feet from the southeast line of lease.
283 feet from the east line and 158 feet from the south line of Haynes, J W survey.
Field rules for the Newark, East (Barnett Shale) Field are:
Gas Special
330 feet from the nearest lease line and 0 feet between wells on the same lease in the same field and reservoir on 320 acre proration units.
Gas Optional
330 feet from the nearest lease line and 0 feet between wells on the same lease in the same field and reservoir on 20 acre proration units.
Oil Special
330 feet from the nearest lease line and 0 feet between wells on the same lease in the same field and reservoir on 40 acre proration units.
This well is to be drilled to an approximate depth of 9,000 feet.
